Vancouver poultry company worked man to death, lawsuit claims

The family of a Chinese immigrant who died after allegedly working excessive hours at a Vancouver poultry processor is suing the company.
The lawsuit, filed last week in B.C. Supreme Court, claims married father-of-four Bao Min Cheng used to work 60-70 hours per week at Hallmark Poultry Processors, and that the strain of working so much overtime killed him... (Posted Wednesday March 25, 2015. 9:33 PM).
The thing is, I was under duress when I quit cleaning St. Michael's University School (SMUS), that day in 2004. I was becoming manic. I had stopped all mental health medication, slowly, under doctor's supervision. I took a long time to believe that I was mentally ill, even though I grew up with my mother being depressed. So I convinced Dr. Chris Fraser to take me off the mental health pills. I was riding on cloud nine as my husband was my boybriend at the time. Actually, he had asked me to marry him like in October 10, 2003. ME, who you are reading from. When I left SMUS that day, I asked 2 girls if they knew my boss. I had so many bosses it was not funny. They said yes. They were young. I threw, yes, threw them the cleaning keys and I said to tell him, I quit. I was admitted to the local mental institution/hospital. I was put back on medication, maybe different medication, and that is when I realised, shit, I was out of a job. I tried to remedy the situation to no success. I even had a doctor's note. I had been replaced, duress or not. Tough! Through God's Grace, I now teach Career Planning 10 (changing soon) at SMUS each year. B4 the cleaning gig, I was a volunteer speaker and on, and on, I stood on giants shoulders and things are what they are. Added Wednesday June 24, 2015. 4:41 PM.

I was a Janitor at Supreme Building Maintenance (changed name – (3 months cleaning in a school). They were local here and were owned by a company in the United States of America. He had hired a friend of mine, a fellow immigrant. They spoke Spanish. When the boss guy quit, I was given the option of suing the American Company and I was like wow, no....(I felt small and insignificant).

IMMIGRATION (Life
fucking experience so horrible that I say, kiss my vulva and suck my
clit). I am blessed to have one! Some girls have had theirs cut off,
including my maternal grandmother for sure. 2013 - MINISTRYI came to Canada to die on a Visitor visa of two months (June 1996), which was extended at the airport for 4 extra months. When the visa expired, I applied for another visitor visa and was granted time for a year. Around this time I was talking to health care providers and stating that I had AIDS. Soon immigration Canada was at my door asking if I was cleaning houses without a permit and if I had HIV. They took me with them and the next day I was handed a solid departure order dated 22 January 1998. I had no passport (had lost it dancing), and I had no funds to self-deport.
This led to near deportation after which I was given a conditional departure order, November 18, 1998. This would go in effect any time. It's power diminished when I was granted permanent residence. So stressful the heavy burden of a conditional departure order.
August 31, 2001 on my daughter's birthday, I applied for permanent residence on Humanitarian and Compassionate grounds.
14 March 2004, a letter with this date stated, "...Specifically, I have received a medical notification stating your are suffering from AIDS. The narrative on this notification states:
This 35-year-old applicant has been diagnosed with HIV and is currently on anti-retroviral agents. While taking these drugs, her viral load is undetectable. However, her T-cell count is 390. In 1992 she had pneumocystis carina and in 1994 she was treated for tuberculosis. This is Aids defining. It is reasonable to expect that Ms. will continue ongoing management by a physician knowledgeable in the treatment of persons living with Human Immunodeficiency Virus. It is also reasonable to expect that this disease will continue and that anti-retroviral drugs will be needed. This treatment is very expensive and is covered by provincial health plans.
Based upon my review of the medical examination and all the reports I have reviewed with respect to her health condition, I conclude that she has a health condition, I conclude that she has a health condition that might reasonably be expected to cause excessive demand on health services. Specifically, this health condition might reasonably be expected to require services, the cost of which would likely exceed the average Canadian per capita costs over 5 year period. She is, therefore inadmissible under Section 38(1)(c) of the Immigration and Refugee Protection Act.
Also has: Depression-Bipolar Disease..."
30 June 2004, I got a letter from Citizenship and Immigration Canada stating in part: "As indicated in the previous letter, a decision about your application for permanent residence has therefore been made based upon information on your file. On 30 June 2004, I a representative of the Minister of Citizen and Immigration reviewed the information on your file and it appears that you are a person described in Section 38 of the Immigration and Refugee Protection Act, that is, a person who is inadmissible on health grounds in that you might reasonably be expected to cause excessive demand on the health or social services in Canada.
As such, permanent residence in Canada cannot be granted to you and your application for permanent residence must be refused. This means that the exemption previously granted in your case from the requirement to obtain an immigrant visa has no further effect..."
During my process with immigration Canada, a Pre-Removal Risk Assessment was done and I was found to be a protected person. Because I had AIDS, I was not considered protected. Today, a protected person who applies under that category has their application processed in 1 year. It was 2003. I would have had my permanent residence by 2004. By 2007 I would have already been a Canadian Citizen.
In 2004, I was given my first temporal resident permit. I felt like a somebody, for the duration.
When we wanted to do a spousal application in 2005, which today takes 82 days, we were told we could not apply under that category because I had a disease. At the least, I would have been a Canadian citizen by 2008. In real life, in 28 August, 2008 (near my Late daughter's birthday), I applied for permanent residence, this time as a temporal resident permit holder. My job was to keep my status valid by renewing my temporal resident permit from Sept 2004 to Oct 2009. Costs $$. Helps the country.
I got my permanent resident card on 12.01.2010. I sent off my citizenship application on March 26, 2012.
@ 1 time on my work visa said, - "must leave Canada by 3 Oct 09"...police cells...detained for about six days. I had a conditional departure order since 1998 that would go into effect at any time, and a threat like this one only helped stress me out more.
I
was again told that I must leave the country on another work visa by 3
Oct 2010. It is not about if I left or not, it is the stress involved.

With the Temporal Resident Permit, I waited for more than three years before applying for permanent residence as advised. My permanent residence was handed to me on January 12, 2010. An official document with a clerical error, Canada. It would take five months to rectify the clerical error. (I was in a hurry to see my daughter's grave of July 1997. Dear Canada,
Let me remind you a little bit about myself. My name used to be ... I was born in Kenya. It is a beautiful land that saw me called names, beaten and raped severally. The first time I ever spoke out about these issues, I was 17 years old. I was sharing with a peer. I did not get another chance to speak until I was released from the immigration detention. I was accused of cleaning houses without a permit, as well as having HIV. In actual fact, I was presenting as a person living with AIDS. Canada, you know that from the time I applied for a visitor visa, the whole process to my citizenship, took 18 years. I could not vote until after citizenship. I was busy with the immigration process. Giving me a place to work and wait in safety. These are the things I want to thank Canada for. I have been able to make decisions in the municipal level, by voting this year. Who would have thought?
Thank you Canada that you undid all the wrong that happened in Kenya and gave me a new slate in Canada. You paid for my health care, you clothed me, you fed me. You made sure that my basic human rights were met. Thank you for making sure that I had legal aid all throughout my immigration case here in BC. I thank you so much Canada for caring for me. A black female doing her best.
Canada, thank you that while I was waiting for my file to close, you kept me busy. I teach about HIV/AIDS so that I educate as many people as I can. Thank you Canada for giving me a platform in which to speak. Even this platform here today.
It has been said that respect begets respect. Let us do this simple act for one another. Let us work together to spread education about HIV/AIDS and stop the stigma that fuels the stem of ignorance. Thank you Canada for showing me that I am working with a team of people who are going to make things happen.
Thank you Canada that since release from detention in 1998, I have done many HIV/AIDS presentations and in all sorts of places including the Wilkinson jail...I have fully told my life story. Thank you Canada for all of the wonderful times...I do miss the old days that got me speaking year in, year out for a good ten years. I believe some of that work saw the AIDS ward in Vancouver close. Do you want it to reopen in another ten years because people went without education of the virus? Canada, you have been so awesome to me and though I may have been disenchanted, I believe we can do something better, together.

Good Lord, it seems citizenship and immigration Canada's aim was to get me to self-deport. Right from how they were handling the near-deportation in 1998 to intimidation along the whole way. I just realized what they intended... Maybe they thought I would die of AIDS related illnesses before the end of the case. The hardships I had to go through, the stress, the grief of Jessy dying away from me, no blood family, the uncertainty and them refusing us, my beloved husband and I, to do a spousal application after we got married in 2005. They said it was because I had a disease. I am sure they meant AIDS.
I was saying this to my friend,
"Well, there was this lady behind the desk at immigration office. I told her that I had come to tell her that I was married and would like to do a name change. She said that I could not do spousal application and she continued to explain without being asked, that it was because I had a disease. She did not say AIDS or manic depressive as God knows I have both. I left. That is how it went down. My lawyer Peter Golden after the three years of temporal resident permit (TRP), wanted me to do another application via humanitarian and compassionate grounds (which I was not granted in a prior application.) My beloved husband and I told him that actually now I needed a TRP application form for permanent residence. It all made me dizzy to say the least. " ~ME.

The obvious tactic they used was that of delaying my case for almost 20 years. OMG! My daughter Jessy's death in Kenya made me strong because I said why was I not there to hold her dying body? I checked the status on my passport. I emailed the passport office to check on things. The prompt update said. "...Your passport was sent to you by Xpresspost on December 18, 2014...Date dropped off or sent by mail / Date déposée au comptoir ou date d'envoi par la poste : 2014-12-12..." Email received today. When my application was accepted on December 12, 2014 as indicated above, I was told the passport would be mailed to my home address on the 30th of December, 2014. So, I was checking mail at home. Today I went by the post office, before I had checked my email, and I found 2 notices saying tomorrow was the last day, to pick up a package! Imagine.
I am expecting a T-shirt from some folks (Omaze) and was surprised to see the package was an envelope, inside, THE PASSPORT! If I was not looking for the t-shirt, I would have missed the passport. I wanted nothing. I was coughing and she asked
if I had TB. I explained no. We had just done 27 hours of flying and
this is the last thing I expected. Like they could have stopped me right
there. The luggage was searched and finally we were let out. I felt bullied. I felt that the permanence of the residence card that allowed me to go to Kenya was kinda temporal.

Today I went to the passport office in the morning. There was a different older gentleman at the receptionist desk. He was saying to have our paperwork ready and put on a smile...
I told him I was there to see Joe. Joe was not there and so I had to line up to be seen. I explained to the lady that things had not been updated, last Friday. She asked if I was a new citizen and I said yes. She was very helpful. She was the lady who was working alongside the lady I saw last Friday. She took the piece of paper in which Joe had written his name and counter number 5. That was from Friday. There were no line ups. You would think it is a different passport office. Maybe because I was there in the morning. Soon, my number A020 was called to counter 13. The lady worked efficiently, the citizenship update must have gone through, I paid for 10 years instead of 5, because I do not like passport offices. I will do anything to avoid them. We were asked to wait 2 business days after taking the Canadian citizenship oath, in order to apply for a Canadian passport. I waited 49 days, at least. Business and non business. I filled out the forms last night, was aware that today is Nelson Mandela's 1st death anniversary, as I walked to the passport office. I waited in line and I told the lady I was there to return the form. (Gucokia fomu). She looked at me with pretend puzzled face and asked, "From where?" "To you," I said, smiling the WHOLE time. I got a number and waited in line again to be seen again. I might have been there just about three hours, or so it felt, with other folk. Soon it was my turn, A68. I was told that my citizenship certificate was valid, and there was a missing link, the last step that had to be done. Joe of counter 5 was very sorry and professional about the whole thing and told me the update maybe done on the weekend. They told us it would be done in 2 days man. ceremony will need to wait at least two business days after their

I was excited to see how the passport office in Kenya would compare to a Canadian one. In Kenya, one would only get a passport if they had proof they were travelling somewhere. The process was like pulling teeth. In Canada, where it looks like any Canadian citizen can get a passport, application forms are easily obtainable. Long line ups for passport forms in Kenya. Delay on both ends. Chairs in Canadian waiting room. Bribery in Kenya. Delay... Backlog, common, major problem in both countries. Canada, I am disenchanted - again. Kenya, behave yourself. And person who types passports in Kenya, My name was ..., not Minnesh. Where did the S come from?. Sabotage! Typists/Secretaries were well trained during my time. What is wrong with you? I had never voted before 10:00 AM this morning. The voting process was very quick, the officers were great. I was still nervous in front of them. Officials do that to me. I was put on the voter's list and given a ballot. I shaded the spots I needed to, the machine took the ballot and I had successfully voted. Yay! I feel like somebody. It just so happened I was in the right country, in the right space of mind and willing to vote. This is great. The sad thing is that like me, many people would have liked to vote since they were 18 and sadly are getting older and cannot vote. The young need to vote as well. So we can turn this Earth around. October 16, 2014, I woke up, got dressed and went to the venue of my citizenship award, ceremony. I was supposed to get there at 8:00 AM and the clock said 8:05 AM. Damn! I was nervous because, I was late to see the judge, and my notice said, among other things, that, You will not be granted citizenship and cannot take the oath of citizenship if any of the following prohibitions apply to you. Mark you, this is on the NOTICE TO APPEAR - TO TAKE THE OATH OF CITIZENSHIP. Very confusing. PROHIBITIONS UNDER THE CITIZENSHIP ACT... #4. ARE YOU NOW, OR HAVE YOU EVER BEEN UNDER A REMOVAL ORDER (HAVE YOU BEEN ASKED BY CANADIAN OFFICIALS TO LEAVE CANADA)?. So, I started by telling the officer that I was being deported in 1998. He took my paper work, he made no eye contact and told me to go to seat number 7. By the time I realized the officer had a badge, it was too late to read it. I was stressed by the process to the very last fucking moment. Anything after that was a blur. The system spit me as a Canadian citizen. I believe it now. I waz then directed to a waiting room. And that is what it was, a waiting room. I waited and waited and then, the same lady, Louise, who took my laboratory requisition, came to take my blood! I came to Canada in summer of 1996, 4th of July, and when I saw the flag, I saw the blood of Jesus and the holiness of the land. You cannot blame me for what I saw. Can you? The snow storm of 1996 in Victoria was my winter welcome to Canada. I had to wear plastic shopping bags with my shoes which let in water. So white, so pure, so holy, was the land. They used to ask for 65%, went up to 75% and now we are at 98%. According to Mavis, who I did some citizen classes with (Great professor), of Intercultural Association (ICA). Jesus have mercy. If one fails, they can do it again if allowed. If one fails then, they have to see the judge, of which I don't know what happens next. Ala! Speaking of Gayle, my girlfriend, Gayle had to face the knife (mastectomy word posted, 14/07/2014) with breast cancer. The cancer came back as bone cancer, Lord have mercy, mercy.
